When Can You Make A Motorcycle Accident Claim In Denver?

After a motorcycle collision, you have three years to make your claim within the statute of limitations set forth in Colo. Rev. Stat. § 13-80-101. This time limit applies to incidents involving a motor vehicle. If you delay beyond the allowed time, you won’t be allowed to make your case. 

You also must show the driver you’re making a claim against was at least 51% responsible for the motorcycle accident. This is because of a legal rule called comparative fault established in Colo. Rev. Stat. § 13-80-102(1). 

As long as the majority of the blame rests on the other driver, you can bring your claim but your damages will be reduced by your own percentage of fault. If the other driver was 90% to blame, you’d be compensated for 90% of your losses. 

How To Make A Denver Motorcycle Accident 

You have to show negligence or intentional wrongdoing on the part of the other driver to be able to recover compensation for a motorcycle accident. 

A case called Perreira v. State, 768 P.2d 1198 (1989) explains what you must prove if you’re making your claim based on irresponsible driver behavior. “To recover on a claim in negligence, the plaintiff must establish the existence of a legal duty, breach of the duty, causation, and damage.”

Every driver has a duty to behave safely on the road, so you’d have to show the other motorist failed to live up to that obligation by behaving less safely than an average reasonable driver would have. You’ll also have to show their actions were the direct cause of the accident and the damages you suffered because of it.
