In December of 2021, almost 8 million disabled workers and over 1.1 disabled adult children received disability benefits from the Social Security Administration.  These benefits provide a lifeline to those who are unable to work due to a long-term illness or injury.

Unfortunately, qualifying for benefits can be a major challenge in most situations. In fact, from 2010 to 2019, just 21% of all applicants were awarded benefits when they first applied. And, even after appealing and going through a multi-step process, an average of just 31% of applicants ended up receiving disability income from Social Security.

Having a good Boulder disability lawyer representing you can maximize the chances you’ll end up among the small minority of applicants who are able to qualify for benefits. Daniels & Scriven, PC has helped many clients to get the help they need and we’re ready to work with you to navigate the application process to maximize the chances of success. Give us a call at (720) 863-6006 today to learn how we can put our decades of experience to work on your claim.

Types of Boulder Social Security Disability Benefits

Disabled individuals may be entitled to two different kinds of disability benefits from Social Security. These include:

  • Social Security Disability Insurance: This is an earned benefit you qualify for based on earning enough work credits. You earn work credits as you do your job and pay Social Security taxes on income. The number of work credits you need depends on your age at the time of disability. SSDI benefits are not means-tested, so you can collect no matter your household income or resources. Your benefit will be based on your career-average wages prior to disability.
  • Supplemental Security Income. These are means-tested benefits intended for disabled and elderly individuals. If your income or household resources exceed a certain threshold, benefits will not be available to you. There is a set monthly SSI benefit not based on your income history, which changes over time and is often much lower than the amount of money SSDI can provide.

A Boulder Social Security disability benefits lawyer can help you determine what benefits you may qualify for based on your work history and financial resources.

Qualifying for Social Security Disability Benefits in Boulder

There are strict requirements to qualify for either SSDI or SSI. The Social Security Administration outlines some of the rules. These include:

  • Having a long-term disability is defined as one that has lasted or will last for at least 12 months or that is likely to be terminal.
  • Not being engaged in substantial gainful activity, which is defined as earning too much income from work.
  • Having an impairment on the Listing of impairments or one that is as severe as those listed. You’ll also need documented medical evidence proving that you show the symptoms required for your specific impairment.
  • Being unable to work or earn a living at your job or at a job with transferable skills.

Daniels & Scriven, PC can help you to prove you qualify for benefits and can assist you in appealing and fighting for Social Security Disability if your initial claim is denied.
